Welcome to Blooms by Becca. These Terms of Service ("Terms") govern your use of our website, products, and services. By accessing or using our website, placing an order, or engaging our services, you agree to be bound by these Terms.
Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you may not use our website or services.
Services
Blooms by Becca provides floral design services for weddings, special events, workshops, and various other occasions. Our services include, but are not limited to:
- Wedding and event floral design
- Wedding planning and day-of coordination
- Floral workshops and classes
- Consultation services for floral arrangements
- Rental of decorative items and accessories
Orders and Payments
Consultations and Quotes
Initial consultations may be offered free of charge or at a fee, as indicated at the time of booking. Following the consultation, we will provide a detailed quote for your event. Quotes are valid for 14 days from the date of issue, unless otherwise specified.
Deposits and Payment Schedule
A non-refundable deposit of 25% of the total quoted price is required to secure your date and our services. The deposit is applied to your final balance. Payment schedules for the remaining balance will be outlined in your contract.
Final Payment
Final payment is due 14 days prior to the event date, unless otherwise specified in your contract. For workshops and classes, full payment is required at the time of booking.
Payment Methods
We accept payments via credit card, bank transfer, and other methods as specified at the time of payment. All payments are processed securely.
Cancellations and Refunds
Client Cancellations
Cancellation policies vary based on the type of service and timing:
- Cancellations made more than 90 days before the event: Deposit is non-refundable, but any additional payments may be refunded.
- Cancellations made 30-90 days before the event: 50% of the total contract value is non-refundable.
- Cancellations made less than 30 days before the event: No refunds will be issued.
Rescheduling
Requests to reschedule may be accommodated at our discretion, subject to availability. A rescheduling fee may apply.
Service Cancellations by Blooms by Becca
In the rare event that we must cancel our services due to unforeseen circumstances, we will make every effort to:
- Provide as much advance notice as possible
- Assist in finding a suitable replacement vendor
- Issue a full refund of all payments received
Substitutions and Variations
Floral design is subject to seasonal availability and market conditions. We reserve the right to make substitutions of flowers or containers if items are unavailable, of poor quality, or exceed reasonable market costs. Any substitutions will maintain the style, theme, and color palette of the original design.
Rentals
For items rented from our collection:
- A security deposit may be required for rental items.
- The client is responsible for any damage, loss, or theft of rental items beyond normal wear and tear.
- All rental items must be returned by the agreed-upon date and time.
- Cleaning fees may apply for items returned in an excessively soiled condition.
Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Blooms by Becca or our content suppliers and is protected by copyright laws.
We reserve the right to use photographs of our floral designs and events for portfolio, promotional, and educational purposes unless you have explicitly requested in writing that we not do so.
Photography Release
By engaging our services, you grant us permission to use photographs of our work at your event for portfolio, social media, website, and marketing purposes. If you wish to restrict this usage, please discuss this with us before the event and include any restrictions in your contract.
Limitation of Liability
Blooms by Becca shall not be liable for:
- Any indirect, special, or consequential damages arising from your use of our services
- Any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions, or supplier failures
- Any allergic reactions to flowers or materials used in our designs
- Any damage caused to venues or other property during the normal course of setup or breakdown, unless due to our negligence
Our maximum liability for any claim shall not exceed the total amount paid by you for the services related to the claim.
Force Majeure
Neither party shall be liable for failure or delay in performing obligations set forth in this agreement if the failure or delay is due to events beyond reasonable control, including but not limited to: natural disasters, adverse weather conditions, acts of terrorism, labor disputes, or pandemic-related restrictions.
Dispute Resolution
In the event of a dispute, both parties agree to first attempt to resolve the matter through direct communication. If the dispute cannot be resolved, the parties agree to seek mediation before pursuing legal action.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following any changes constitutes your acceptance of the modified Terms.
